Passenger Liability & Safety Notice

Your safety is our priority. By using DitropGo’s ride-hailing services, you agree to the safety terms and passenger responsibilities outlined below. These standards are designed to ensure safe, respectful, and compliant transportation for all riders and drivers in accordance with New Brunswick laws, Saint John ride-hailing regulations, and DitropGo’s internal policies.

1. Passenger Responsibilities

To maintain a safe ride environment, passengers are required to:

  • Enter and exit the vehicle safely and only at appropriate, safe locations.
  • Wear a seatbelt for the entire duration of the trip, as required by law.
  • Treat the driver and the vehicle with respect and avoid conduct that may distract, endanger, or impede safe operation.
  • Ensure all minors in their care are properly restrained in accordance with New Brunswick child restraint regulations.
  • Avoid causing damage to the vehicle or engaging in disruptive, illegal, or unsafe behaviour.
  • Comply with all DitropGo instructions and any lawful requests from the driver related to safety.

Failure to comply may result in trip cancellation, account suspension, additional charges, or reporting to authorities where required.

2. Prohibited Conduct

For safety, passengers must not:

  • Bring open alcohol, illegal drugs, weapons, or hazardous materials into the vehicle.
  • Engage in abusive, threatening, or violent conduct toward drivers, other passengers, or third parties.
  • Manipulate, distract, or interfere with the driver’s ability to operate the vehicle.
  • Request the driver to perform unsafe or illegal actions (e.g., speeding, road violations, unsafe pickup locations).
  • Smoke, vape, or ignite flames inside the vehicle.

DitropGo reserves the right to immediately deactivate any rider account linked to prohibited or unsafe conduct.

3. Passenger Liability

Passengers may be held financially responsible for:

  • Damage to the vehicle caused by negligence, misconduct, or prohibited items
  • Cleaning or remediation fees for spills, stains, bodily fluids, or excessive mess
  • Costs associated with misconduct that leads to trip interruptions, cancellations, or safety incidents
  • Any unlawful behaviour that results in enforcement actions, fines, or penalties

Charges will be applied directly to the payment method associated with the rider account.
In cases of dispute, passengers may contact support for review.

4. Driver Safety Discretion

Drivers retain the right to:

  • Refuse or cancel a trip if they feel unsafe
  • End a trip immediately in the event of threatening, unsafe, or illegal passenger behaviour
  • Report safety incidents to DitropGo and/or local authorities

DitropGo supports a zero-tolerance policy for violence, harassment, and discrimination.

5. Personal Items and Lost Property

Passengers are responsible for their own belongings. DitropGo is not liable for:

  • Items left in vehicles
  • Loss or damage to personal property before, during, or after a trip

Drivers may turn in lost items at their discretion, but recovery is not guaranteed.

6. Assumption of Risk

By using DitropGo, passengers acknowledge and accept the inherent risks associated with:

  • Road transportation
  • Weather conditions
  • Vehicle malfunctions
  • Actions of third parties (including other road users)

DitropGo strives to mitigate these risks but cannot guarantee absolute safety.

7. Limitation of Liability

To the fullest extent permitted by New Brunswick and Canadian law:

  • DitropGo is not liable for indirect, incidental, consequential, or punitive damages arising from use of the service.
  • DitropGo is not responsible for delays, cancellations, or events caused by factors outside our control, such as traffic, weather, emergencies, or third-party actions.
  • Riders accept that drivers are independent contractors and not employees, and DitropGo is not liable for their independent conduct beyond statutory requirements.
8. Emergency Situations

In an emergency, passengers should call 911 immediately.
Drivers are expected to follow lawful instructions from emergency personnel.
DitropGo may cooperate with authorities and provide information as legally required.

9. Updates to This Notice

DitropGo may modify this Passenger Liability & Safety Notice periodically. Updated notices will be posted on our website and app. Continued use of the service constitutes acceptance of the revised terms.
